FAQ
How far back does SSDI back pay go?
Up to twelve months before your application date, and only for months after your established onset date. A five-month waiting period is then subtracted, so the earliest month SSDI can actually pay is the sixth full month after onset.
Does SSI pay back pay the same way?
No. SSI has no five-month waiting period and no retroactive months before the application date — it starts the month after you apply. Large SSI back pay awards are also usually paid in up to three installments rather than one lump sum.
How much can a disability lawyer charge?
Federal rules cap representative fees at 25% of past-due benefits or a statutory dollar cap, whichever is less. The fee comes out of back pay only — it is never taken from your ongoing monthly benefit.
Is disability back pay taxable?
It can be, if your total income for the year exceeds the thresholds for taxing Social Security benefits. The IRS allows a lump-sum election that spreads the back pay across the years it was owed, which usually lowers the bill.
