  "summary": "Estimate retroactive benefits, the five-month waiting period, and the attorney fee cap.",
  "description": "Social Security Disability Insurance pays benefits back to the point entitlement began, which is rarely the date you applied. Two rules control the number: a five-month waiting period that starts from your established onset date, and a retroactive limit of twelve months before the application date for SSDI. Add the months a claim spends in reconsideration and hearing queues and back pay commonly reaches five figures. This calculator applies the waiting period, counts payable months from entitlement to approval, multiplies by your monthly benefit amount, and then subtracts the representative fee, which federal rules cap at 25% of past-due benefits up to a dollar ceiling set by SSA. It reports gross back pay, the fee, and what actually reaches you. It is an estimate for planning only — SSA determines your onset date, your primary insurance amount, and any offsets for workers' compensation or public disability benefits.",
  "formula": "Payable Months = Months from (Onset + 5) to Approval, capped at 12 months before application. Back Pay = Payable Months × Monthly Benefit. Fee = min(25% × Back Pay, Fee Cap).",

    {
      "q": "Can retroactive pay go back more than a year?",

      "q": "Is the attorney fee always 25%?",

      "q": "Is back pay taxable?",
      "a": "It can be. A lump sum covering prior years may be partially taxable depending on total household income, and the IRS allows a lump-sum election to apply prior-year rules. Discuss it with a tax preparer."
